1. Information on the collection of personal data, and controller’s contact data

Personal data is all data by means of which you can be personally identified.

Pursuant to the General Data Protection Regulation (GDPR), the controller, i.e. the party responsible for data processing on this website, is

The controller is the natural or legal person who decides, alone or with others, on the purposes and means of processing personal data.

For security reasons and to protect against the transferal of personal data and other confidential contents (e.g. orders or inquiries to the controller), this website uses SSL or TLS encryption. You can recognize an encrypted link by the characters “https://” and the lock symbol in your browser line.

2. Data collected when visiting our website

If you use our website only for information purposes, without registering or otherwise giving us information, we only collect the data that your browser transfers to our server (server logfiles). When you access our website, we capture the following data that is technically necessary for us in order to show you the website:

  • Our website that you visit
  • Date and time of access
  • Data sent in bytes
  • Source/reference that you came to the site from
  • Browser used
  • Operating system used
  • IP address used (poss. in anonymized form)
  • Processing occurs per Art. 6 Para. 1 lit. f GDPR based on our legitimate interest in improving the stability and functionality of our website. Data is not transferred or used for other purposes. However, we reserve the right to examine server logfiles subsequently if there are specific indications of illegal use.

This data is evaluated only to improve our website offering, and permits no conclusions to be drawn about your person.

3. Contact

When you contact us (for example by contact form or e-mail) we gather personal data. The nature of the data we gather can be seen from the contact form you use. This data is stored and used only to answer your inquiry or contact you and for the associated technical administration. The legal basis for processing the data is our legitimate interest in answering your inquiry per Art. 6 Para. 1 lit. f GDPR. If the contact is made with the intention of making a contract, the additional legal basis for processing is Art. 6 Para. 1 lit. b GDPR. Your data will be deleted after processing, which is the case when circumstances indicate that the matter in question has been fully dealt with and where there is no statutory obligation to retain data.

4. Rights of data subjects (affected persons)

Data protection law provides data subjects with comprehensive rights vis-a-vis the controller with regard to the use of personal data (disclosure and intervention rights), as explained below:

Right to disclosure per Art. 15 GDPR: In particular, you have the right to information on your personal data that we use, the purposes we use it for, the categories of personal data used, the recipients or categories of recipients to whom your data is or will be revealed, the planned duration of storage or the criteria for determining the duration of storage, the existence of a right to rectification, erasure and restriction of processing of data, the right to object to processing, the right to lodge a complaint with a supervisory authority, the source of your data if not collected by us, the existence of automated decision-making including profiling, and if so meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing, and your right to be informed of the safeguards pursuant to Art. 46 GDPR where personal data is transferred to a third country;

Right to rectification per Art. 16 GDPR: You have the right to the rectification and/or completion, without delay, of inaccurate or incomplete personal data concerning you.

Right to erasure per Art. 17 GDPR: You have the right to obtain from us the erasure of personal data concerning you where grounds per Art. 17 GDPR exist. However, this right does not apply when the processing is necessary for the exercise of the right of freedom of expression and information, to meet a legal obligation, for reasons of public interest, or for the assertion, exercise or defense of legal claims.

Right to restriction of processing per Art. 18 GDPR: You have the right to obtain from us restriction of processing: while we verify the accuracy of the personal data if its accuracy is contested by you; if the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead; if you need the data for the establishment, exercise or defense of legal claims but we no longer need it for processing purposes; if you have objected to processing based on your particular situation and it is not yet clear whether our legitimate grounds override.

Right to notification per Art. 19 GDPR: If you have asserted the right to rectification, erasure or restriction of processing to the controller, the controller is obligated to inform all recipients of your personal data pertaining of this rectification, erasure or restriction of processing, unless this proves impossible or involves unreasonable effort. You have the right to be informed of these recipients.

Right to data portability per Art. 20 GDPR: You have the right to receive your personal data that you have provided to us in a structured, common, and machine-readable form, or to demand transfer to another controller in so far as this is technically feasible.

Right to withdraw consent per Art. 7 Para. 3 GDPR: You have the right to withdraw your consent to processing of your data at any time, effective from that time. In the event of such withdrawal of consent, we will erase the respective data without delay, in so far as further use is not based on legal grounds for processing without consent. Withdrawing your consent does not affect the legality of the use of data with your consent prior to revocation.

Right to lodge a complaint per Art. 77 GDPR: If you believe that processing of personal data pertaining to you is in breach of GDPR, you have the right, regardless of other administrative or legal remedies, to file a complaint to a supervisory authority, especially in your Member State of residence, workplace or location of the presumed breach.

RIGHT TO OBJECT

IF IN WEIGHING THE INTERESTS OF DIFFERENT PARTIES, WE PROCESS YOUR PERSONAL DATA ON GROUNDS OF AN OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THIS PROCESSING FOR REASONS BASED ON YOUR PARTICULAR SITUATION, EFFECTIVE FROM THE TIME OF YOUR OBJECTION.

IF YOU MAKE USE OF YOUR RIGHT TO OBJECT, WE WILL CEASE THE PROCESSING OF THE AFFECTED DATA. BUT WE RESERVE THE RIGHT TO FURTHER PROCESSING IF WE CAN PROVE COMPELLING REASONS WORTHY OF PROTECTION FOR SUCH PROCESSING THAT OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF SUCH PROCESSING SERVES THE ASSERTION, EXERCISE OR DEFENSE OF LEGAL CLAIMS.

IF WE PROCESS YOUR PERSONAL DATA TO DO DIRECT ADVERTISING, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF PERSONAL DATA PERTAINING TO YOU FOR SUCH ADVERTISING PURPOSES. YOU CAN MAKE YOUR OBJECTION AS DESCRIBED ABOVE.

IF YOU MAKE USE OF YOUR RIGHT TO OBJECT, WE WILL CEASE THE PROCESSING OF THE AFFECTED DATA FOR ADVERTISING PURPOSES.

5. Duration of storage of personal data

The duration of storage of personal data is based on the respective statutory retention period (e.g. trade and tax retention periods). When the end of this period is reached the data is routinely erased unless it is needed to perform or initiate a contract and/or we have a legitimate interest in further storage.
